If Obamacare is Upheld….

While the country anxiously awaits the US Supreme Court’s opinion on the constitutionality of Obamacare The Truth About Guns blog takes an unique look at the individual mandate and what it could imply if upheld.  For some reason I don’t see the liberals getting behind this individual mandate.

Opponents argue that if you can tell people they have to buy insurance, there’s no limit to the requirements with which government can saddle them. James Johnson, in a letter to the editor of syracuse.com, takes the idea of an individual mandate to the next logical level suggesting that Americans also be required to purchase a gun. To the Editor:

There is nothing in the Constitution that guarantees a citizen the right to health care. Yet the Obama administration passed a law that contains an individual mandate for citizens to purchase health care. The justification is an extremely warped interpretation of the commerce clause.

In contrast, the Second Amendment guarantees the right of citizens to keep and bear arms.

In the wake of the Supreme Court’s Heller decision affirming Second Amendment rights, violent crimes plummeted in Chicago. Murder fell by 14 percent, robberies using guns fell by 25 percent and assaults using guns fell by 37 percent.

Also, an armed citizenry is the first line of defense. Based on this, the Republicans in the House should introduce legislation that all citizens who can pass a background check be mandated to purchase a firearm. There is far more justification for this mandate based on the Second Amendment than for the Obamacare mandate, no matter how you try to stretch the commerce clause.

This may not get through the Democratic Senate or past President Obama. If nothing else though, it may give the liberals on the Supreme Court something to think about. After all, there may come a day when the Republicans control both houses of Congress and the presidency. If the government can make us buy health care insurance against our will, there is nothing to stop them from mandating purchase of a firearm.

Governor Perry Tells CNBC Obamacare will “Bankrupt the States”

Texas Governor Rick Perry recently appeared on CNBC with Florida Governor Rick Scott.  Governor Perry stated that Obamacare will “bankrupt the states.”  You can watch the interview here.

Day two at the ObamaCare oral arguments went well for Texas. ObamaCare is on life support. The Justices hammered Obama’s lawyer, repeatedly raising the concern that ObamaCare overreaches too far into our individual liberty. Justice Kennedy said: “This is unprecedented. It’s beyond what our cases allow.” He added that ObamaCare fundamentally alters the relationship between the government and individuals. Chief Justice Roberts said upholding ObamaCare would create a slippery slope that could give Congress unlimited power to force you to buy things. Justice Scalia pushed back hard against ObamaCare, suggesting that it exceeds the enumerated powers given to Congress under the constitution. Today we are closer to the end of ObamaCare.

Texas Takes Steps to Block Obamacare On its One Year Anniversary

One year ago the U.S. Congress completed one of the most infringing programs in our country’s history known as ObamaCare.  To mark this anniversary the Texas House State Sovereignty Committee passed out three bills aimed directly at the heart of Obamacare.  These proposals all address the costly, unfunded federal healthcare mandates in a variety of ways, including prohibition of, studying of, and expressing Texas’ opposition to the federal healthcare reforms.


After passage of the bills State Sovereignty Committee Chairman Brandon Creighton stated that “House Bill 32, 335, and House Concurrent Resolution 27 all help defend our individual freedoms and allow personal choices with regard to medical decisions.”

Resistance against ObamaCare has been determined and widespread throughout Texas and our nation.  Twenty-six states, including Texas, are suing the federal government for unconstitutional mandates and eight states have passed legislation against ObamaCare.  In January, the United States House of Representatives voted to repeal ObamaCare, and public opposition to the new health restrictions remains strong in Texas and nationwide.

HCR 27 by Rep. Wayne Christian explicitly expresses the will of the people that Texans are opposed to the implementation of Obamacare in Texas.  Rep. Christian said he is “thrilled on the one year anniversary of ObamaCare, one of the most infringing programs in our country’s history, we have taken a step forward to terminate Obamacare in Texas by passing HCR 27.  Texas will triumph over this unprecedented federal mandate on behalf of our citizens.”

House Bill 32, which Creighton authored, is modeled after Virginia’s bill, passed last year, that prohibits residents of the state from being required to purchase healthcare coverage.

House Bill 335, authored by Representative Mark Shelton (R, Ft. Worth), requires state agencies, before implementing any part of the federal healthcare law, to issue a report to the Legislative Budget Board, that states the impact and consequences of having to comply with federal mandates.

Why We Still Need HJR 51

President Obama and his White House communications team have dismissed U.S. Federal Judge Vinson’s ruling against Obamacare as “overreaching” and continued with “We don’t believe this kind of judicial activism will be upheld, and we are confident that the Affordable Care Act will ultimately be declared constitutional by the courts.”

It may take a couple years for the case to reach the U.S. Supreme Court where a final binding decision will be made.  In the mean time expect Obama and his team to go full steam ahead implementing Obamacare.

That is why in Texas we need to continue to support HJR 51 filed by the Texas Conservative Coalition President Rep. Wayne Christian.  If passed HJR 51 will go to the voters of Texas for approval in the November 2011 general election to amend the Texas Constitution and effectively prevent Texans from  having to purchase government-approved health insurance under the threat of penalty.

Rep. Christian’s resolution addresses health care freedom in numerous ways.  Texans’ right to choose a health care system and to control their health care plan will be protected.   Additionally, residents will be able to pay directly for health care services.  This will prevent any penalties or fines from being imposed, which will further protect the right of citizens to spend their money as they please.

Rep. Christian stated, “If passed HJR 51 will support Texas Attorney General Greg Abbott’s lawsuit against Obamacare on behalf of Texas.  As the legislative session begins, it is crucial we continue working together to terminate this unconstitutional mandate of the federal government.”

Federal Judge Rules Obamacare Unconstitutional

Federal Judge Roger Vinson of the Northern District of Florida Court ruled that Obamacare is unconstitutional and the entire law is void.

Ronald Reagan appointed Vinson to the bench in 1983, a very fitting present to honor the 100th birthday of Reagan.

By my count three Federal Judges have ruled against Obamacare while one has ruled for Obamacare.

These rulings taken all together this is very good news because I am told it could fast track the appeals process to the U.S. Supreme Court since the Supreme Court takes a special interest in cases that have been ruled on differently by separate federal district courts.  This could take a couple years though for the case to work its way up to the Supreme Court even if it is fast tracked.

In Texas your State Representatives are trying to pass HJR 51 that will attempt to block the enforcement of Obamacare in Texas.  If passed HJR 51 will go to the voters of Texas as a constitutional amendment in the November 2011 general election.  Has your State Representative signed onto the bill yet?

 

Federal Judge to Rule on Obamacare Today

Texas Attorney General Greg Abbott announced on facebook today that a Federal Judge is expected to rule on Obamacare today.

Rep. Christian Files HJR to Prevent Enforcement of Obamacare in Texas

Today State Representative Wayne Christian filed his first bill of the 82nd legislative session, HJR 51, that will protect Texans from the Patient Protection and Affordable Care Act, otherwise known as Obamacare.

If HJR 51 is passed by the Texas House and Senate and approved by the Governor it will then go to the voters of Texas for approval in the November 2011 general election as an amendment to the Texas Constitution.

Austin, TX- Today, State Representative Wayne Christian filed a House Joint Resolution (HJR) to protect Texans from the Patient Protection and Affordable Care Act, otherwise known as Obamacare.  The federal court recognized serious issues with the health care law, and further stated all States have the right to challenge the health care law.   If passed HJR 51 will then go to the voters of Texas for approval in the November 2011 general election to amend the Texas Constitution and effectively prevent Texans from  having to purchase government-approved health insurance under the threat of penalty.

Constituents have repeatedly expressed their concerns and Rep. Christian has worked tirelessly to ensure that health care rights of Texans are protected.   “I have made this resolution my top legislative priority.  It is unconstitutional for the federal government to impose a federal health care law which forces Americans to buy a specific health care plan,” stated Rep. Christian.

Obamacare infringes upon individual rights and patient choice, reduces medical research, and will further lead our country into more debt.  A law or rule must not compel- directly or indirectly- any person, employer, or heath care provider to purchase a service under the threat of penalty or sanction by the federal government.  Obamacare undermines the people’s rights and the foundation upon which America was built.
